The legal landscape of Thailand changed with introduction of new product liability legislation on 20 February 2009.
In conjunction with the Consumer Case Procedures Act (August 2008) this is a significant change to the liability terrain for businesses operating in Thailand.
These new laws can provide for strict liability when a person is injured by products, permit courts to award emotional distress and punitive damages, and permit the courts to order product recalls.
Product manufacturers, importers, suppliers, wholesalers and retailers: take note!
These laws represent substantial change in Thai law and civil procedure by introducing new contingent liabilities for many businesses operating in Thailand.
Defensible decision-making is about proof of what you say happened. Evidence-based practice is the catch-phrase to describe best practice in risk management.
Assuming sound management and compliant practice, it remains only to prove both of these if your business or its personnel are challenged under the new laws. That comes back to what is--or could be reasonably known--and to the documents and records created in the course of business.
